("AdviZen", "we", "us", or "our"), a private company incorporated on November 22, 2025, under the Companies Act, 2013, with its registered office in Dombivli, Thane, Mumbai Maharashtra, India, and having acquired the business of Maitreya Consultants on March 31, 2026, specializes in HR consulting and advisory services to clients including leading multinational corporations (MNCs). This Privacy Policy ("Policy") details how we collect, use, disclose, and protect personal data as a Data Fiduciary under the Digital Personal Data Protection Act, 2023 ("DPDP Act"), Information Technology Act, 2000 ("IT Act"), IT (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 ("SPDI Rules"), and global standards like GDPR for MNC engagements.

We commit to lawful, fair, and transparent processing with robust safeguards, including ISO 27001-aligned security practices. By accessing our website (advizen.in) or services, you ("Data Principal", "you", "your") consent to this Policy.

Personal Data We Collect

  • Contact Data: Name, email, phone, address from forms or inquiries.

  • Professional Data: Resumes, employment history, skills, references for HR advisory.

  • Sensitive Data: Financial (salary), health (if relevant to advisory), collected only with explicit consent.

  • Technical Data: IP address, browser type, device info, cookies, analytics via Google Analytics/Ads.

  • Other: Usage logs, feedback.

We collect data directly, via third-party tools, or public sources (e.g., LinkedIn). Children's data is not processed.

Lawful Purposes and Use

Processing occurs for legitimate purposes:

  • Delivering HR services (e.g., talent advisory, compliance consulting).

  • Responding to queries, improving services.

  • Analytics, marketing (with consent).

  • Legal compliance. No automated decisions/profiling.

Consent is free, specific, informed, unconditional, and withdrawable. Notices specify data, purpose, and withdrawal method.

AdviZen MaCo HR Pvt. Ltd. ("AdviZen", "we", "us", "our"), incorporated on November 22, 2025, under the Companies Act, 2013, registered at [Full Address], Pune, Maharashtra, India (CIN: [Placeholder]), and acquirer of Maitreya Consultants' business on March 31, 2026, operates advizen.in ("Site") and offers HR consulting/advisory services ("Services"). These Terms and Conditions ("Terms") form a binding contract between you ("User", "you") and AdviZen.


Acceptance: By clicking "I Agree", submitting forms, or using Site/Services, you unequivocally accept these Terms, Privacy Policy, and updates. If using on behalf of entity, you warrant authority. No use without acceptance. Disputes on acceptance resolved under Governing Law. Minors (under 18) require guardian consent.

Eligibility and User Accounts

Must be 18+ with capacity to contract. Provide accurate info; secure credentials. Notify breaches. We may verify/deny access.

Description of Services

Site offers info on HR consulting; Services (talent advisory, compliance) via separate Master Service Agreements (MSAs)/consultancy contracts ("Client Agreements"). No outcome warranties.

User Obligations

  • Submit truthful data.

  • Clients: Ethical candidate handling; comply with labor laws.

  • Candidates: Accurate profiles; no platform misuse.

  • Respect IP; no scraping/hacking.

Intellectual Property Rights

Content proprietary; fair use only. Trademarks not to be used commercially. User submissions licensed non-exclusively to us.

Prohibited Activities

  • Illegal/unethical conduct.

  • Harassment, spam, IP infringement.

  • Reverse engineering. Violations lead to termination/bans.

Fees, Payments, and Billing

Site free and value added services if any; Services per Client Agreement. GST extra. Net 30 days; 1.5% monthly late fee. No refunds except if stated explicitly.

Confidentiality (HR-Specific)

Users agree to keep confidential our/your info (e.g., client lists, candidate data, strategies). Survives termination 3 years. Non-disclosure breaches trigger injunctions/damages.

Non-Solicitation and Non-Compete

Clients/Candidates: No poaching our staff/candidates for 18 months post-engagement. Non-compete limited to Services scope, 18 months, enforceable per Indian law.

Disclaimers and Warranties

"As is" basis. No implied warranties (merchantability, fitness). HR advice informational; seek legal counsel.

Limitation of Liability

Aggregate liability subject to case. Excludes indirect/consequential damages.

Indemnification

Indemnify against third-party claims from your breach/use (e.g., inaccurate data causing liability).

Force Majeure

No liability for delays from acts of God, wars, pandemics, cyber-attacks, government actions beyond control.

Termination

Immediate termination for breach. Post-termination: pay dues, delete data, cease use. Surviving: IP, confidentiality, liability.

Governing Law and Dispute Resolution

Indian law; exclusive Bombay bench courts. Pre-suit mediation (30 days). Arbitration under Arbitration & Conciliation Act, 1996.

Third-Party Services

Google APIs per their terms; we not liable.

Miscellaneous

  • Severability: Invalid provisions don't affect others.

  • Waiver: No implied.

  • Assignment: We may; you need consent.

  • Entire Agreement: Supersedes priors.

Changes

Posted with date; 30-day notice for material changes.
